La empresa extranjera debe OTORGAR PODER para que un apoderado residente en Perú pueda firmar la minuta y escritura pública de constitución de empresa peruana.
El poder debe ser otorgado ante CONSULADO PERUANO DEL PAIS EXTRANJERO, de preferencia.
Se debe acreditar que quien otorga el poder cuenta con las FACULTADES para realizarlo y DESIGNAR A LA PERSONA AUTORIZADA para realizar el trámite ante SUNARP.
Se recomienda APOSTILLAR EL PODER y si en caso se ha otorgado en idioma extranjero se deberá realizar la TRADUCCIÓN OFICIAL cuando el documento llegue a Perú.
Una vez INSCRITO EL PODER ante SUNARP, se podrá CONSTITUIR LA EMPRESA PERUANA.
